Introduction

Offerscout offers a wide range of services that focus on all stages of mineral management & mineral divestitures.

We know that everyone’s mineral ownership is different and the marketplace can be very overwhelming.  Managing mineral rights is a personal experience.  There is very little information on how your mineral offers are generated.  We use the information you give us to provide our services and help you better understand the market value of your mineral interests.  

We carefully evaluate how we use data to make sure that we are using the information you share to provide value. On this page, we aim to explain everything you need to know about your privacy at Offerscout.

Each time you use Offerscout, however, the current version of this Privacy Policy will apply and Offerscout may modify this policy as it sees fit. Accordingly, each time you use Offerscout you should check the date of this Privacy Policy (which appears at the beginning of this document) and review any changes since the last time you used the Website.

IMPORTANT: BY USING THE APPLICATION, YOU GIVE YOUR CONSENT THAT ALL PERSONAL DATA THAT YOU SUBMIT MAY BE PROCESSED BY US IN THE MANNER AND FOR THE PURPOSES DESCRIBED BELOW. IF YOU DO NOT AGREE TO THE APPLICATION’S TERMS AND TO THE PRIVACY POLICY SET FORTH HEREIN, DO NOT USE THE APPLICATION. 

Data Collected By Offerscout

When you use our services, we collect a variety of information from and about you and your devices.  Some of this information identifies you directly (like an email address) while some of it is associated with you through your account, profile, or device (like the information on the oil and gas assets that you provide).

The kind of data we collect about you depends on how you use Offerscout.  The more information you provide the more data we will be able to collect. 

a. Information you Provide to Us:  Personally Identifiable Information.  We collect certain personal information when you provide it to us, such as when personally identifiable information is voluntarily provided when you use the Application, register for an account, and when you electronically communicate with us.  This usually includes basic information like your name, email address, and phone number.  If you use our Offer Management Service, we might ask you to provide more sensitive data regarding your personal mineral ownership information, your Offer Letters & Verbal Offers.  If you contribute information, such as agent reviews, we will store that as well.  We may also collect information about the products and services you purchase or consider purchasing from us. 

You may also provide information about other people through our services. For example, if you share Offer Letters from someone, we will collect that person’s information as part of your account information.

b. Information we Collect Automatically: Non-Personally-Identifying Information.  Along with the information you give us directly, we collect or may have a third-party service provider collect, non-personally-identifying information of the sort that mobile applications typically make available, such as the type and model of device using the Application, the mobile device’s service provider, the operating system, location information, aggregated user statistics, activity information. 

We use various tools to collect data when you visit our sites and apps, including cookies, pixel tags, and other similar technologies. Cookies are bits of electronic data that can be transferred to your computer or other device to identify your browser.

How Offerscout Uses and Shares Information

a. To Provide Products, Services, and Information. As described above, we collect information from you so that we can communicate with you, and provide and deliver our information and services to you. We may use your personal information to digitize your paper offers and use your revenue statements to provide easy to understand cashflow analysis, or to inform you about other products and services available and new offerings from Offerscout.  

We may use third parties to help host the Application, send out email updates about the Application and/or Offerscout, provide marketing and advertising services for us, and improve our existing services and develop new ones. For example, we track how you use our websites and apps and use that information to troubleshoot issues and adjust things to improve your experience. Offerscout may share data with trusted partners to help perform statistical analysis, send you email or mail, provide customer support, or as otherwise required to deliver the requested services. When Offerscout hires a service provider to help operate our business, we may need to give them access to information to provide their service.  We allow them to use the information only to perform the service we have asked them to perform.  We vet all service providers carefully, and Offerscout always remains responsible for the privacy of your information that is shared with our service providers. We understand that sharing information with third parties is a big responsibility.  We are committed to sharing information only when needed for a legitimate business or legal purpose, and then only with recipients who will protect it. 

Occasionally, there may be a reason we would like to use your information in a way that isn’t described here.  If that happens, we will let you know so you can decide if you are comfortable with it.

b. Prevent Fraudulent and Illegal Activity.  We also use your data to detect, investigate, and prevent fraudulent and other illegal activities and to protect the rights and property of Offerscout, its customers, and others.

c. Legal Proceedings.  When Offerscout needs to share data to satisfy a legal or regulatory requirement, including responding to a subpoena or other lawful government request for data, we will share information only as necessary to comply with that requirement.  We will tell you before sharing your information in these situations unless we are prohibited from doing so.  We may also share information if needed to enforce our legal rights, detect or prevent fraud or security concerns, and protect public safety.

d.  Transfer in the Event of Sale or Change of Control. If the ownership of all or substantially all of our business changes or we otherwise transfer assets relating to our business such as by merger, acquisition, bankruptcy proceeding or otherwise, we may transfer or sell your personal information to the new owner. In such a case, unless permitted otherwise by applicable law, your information would remain subject to the promises made in the then-current version of the Privacy Policy unless you agree differently.

 Managing Communications Preferences

Email Subscriptions. Offerscout may send you email for a variety of reasons.  If you have an account with Offerscout you can select your preferences through your account settings. Also, you can manage the types of email you receive by following the instructions included in each email we send you. Even if you unsubscribe from some email subscriptions, we may still need to email you with important transactional or other non-advertising information.

Protecting Your Information

We understand that no matter how we collect your information, we have a responsibility to protect it.  We take that responsibility seriously.  We build security into our products and features to help protect data from unauthorized access, disclosure, alteration, and destruction.

We are always looking for threats and take reasonable steps to respond to those threats, protecting the information users share with us.  Of course, no method of Internet transmission or data storage can provide guaranteed protection to your information.  If anything should ever happen to your information, we will let you know as soon as we can and try our best to make it right.

Governing Law

Offerscout is based in the United States and the information we collect is governed primarily by U.S. law.  Where we are subject to the privacy laws of other countries, we comply with those requirements.  If you access or use our services or provide information to us, your information will be processed and stored in the United States, where you may not have the same rights and protections as you do under your local law.



Applicability of this Policy

This policy applies to every service of Offerscout’s that links to it. Our apps and services may link to other companies’ websites. Some features may also involve the sharing of your information with third-party websites. These third-party websites may collect information about users on those websites.  Offerscout does not control those sites, and this privacy policy does not apply to these external websites and third parties. The use of your personally-identifiable information by our service partners is governed by the respective privacy policies of those providers, and is not subject to our control. Except as otherwise discussed in this Privacy Policy, this document only addresses the use and disclosure of information we collect from you. Other sites accessible through this Application, including our service partners, have their own privacy policies and data collection, use and disclosure practices. Please consult each site’s privacy policy. We are not responsible for the policies or practices of third parties. 

Legal Disclosures

In this section, we have provided some legally required disclosures under state privacy laws.  

Under the California Consumer Privacy Act or CCPA, California residents have certain rights regarding their data, including:

The right to know the categories of personal information we’ve collected and the categories of sources from which we got the information.

The right to know the business purposes for sharing personal information.

The right to know the categories of third parties with whom we’ve shared personal information.

The right to access the specific pieces of personal information we’ve collected and the right to delete your information.

California residents also have the right to not be discriminated against if they choose to exercise their privacy rights.
